Got bad news Yesterday

A couple of months back there was plans to build a 24 hour Grain Bunker complex next to us, it all went quite & the word was it was not to proceed. I got the letter yesterday advising me of the planning permit application has been submitted. It's now bigger & going in behind us now. Eight bunkers, 7 Silos, a dam & maintenance buildings. Lots of light towers too!

I really feel for you - we have just bought a home in another location to escape the clutches of bunnings. i cant even begin to imaging the mice and rat problems once that grain silo gets established let alone the light and dust.

Did you end up getting any legal advice regarding your options Doug? At the very least I'd be wanting above market value for the property to enable a shift.

Doug,
Have a chat with the planners in the council to see what conditions they have imposed (or thinking of imposing).
Typically, you can argue for conditions to be put on the permit based on "residential amenity" grounds. Eg of residential amenity include traffic, noise, unshielded lights, hours of operation (trucks and lights).
Depending on how close you are, you may want to ask for extra high fencing, re-alignment of entry/exit as well.
PM me if you want more info.
Cheers,
Bo

Well firstly there is no interest to buy us out. Secondly due to the size & relocation there are now 3 other parties not happy about it. So this time I have extra & bigger persons prepared to object as well. I put a copy up at the General store, It's really caused a buzz. The council said yesterday their requirement was only to advise adjoining properties & no public newspapers or other notices would be issued. I've fixed that!

Hi Bo,
I don't think my complaints will amount to much. However the others against it are much bigger & wealthier than me. So there is hope.
