I suspect it would be futile to try to extract money from spammers just by referring to the Ts & Cs - they have no morals at all, so they certainly won't worry about the legalities of what they signed up for.
Speaking of Ts & cs - did you see the recent "experiment" in Britain where a Wi-Fi hot-spot company put in some rather bizarre Ts & Cs in the fine print (you know, those pages and pages of information that you have to scroll through, and tick the box at the end acknowledging that you've read and understand the terms), requiring applicants to do 1,000 hours of community service, including:
Cleansing local parks of animal waste
Providing hugs to stray cats and dogs
Manually relieving sewer blockages
Cleaning portable lavatories at local festivals and events
Painting snail shells to brighten up their existence
Scraping chewing gum off the streets
22,00 people signed up!
There was also a prize offer for anyone who contacted the company and pointed out the clause. Only one person received a prize.
