Yes, of sorts, and I was acting for the bloke. If you are interested, look at the decision of Maitland v Royal Blind Society (2004), NSW Industrial Relations Commission (use AustLIi website). Whilst Mr Maitland lost at first instance, the full bench overturned the decision and found in his favour on appeal. I won't bore the rest of you with the details!!!
