Must all employers comply with the meal break requirements?
7.1 An employer must not require an employee to work more than 5 hours
continuously without an unpaid interval of at least 30 minutes for a meal.

following industrial instruments:
· an award;
· a workplace agreement;
· a pre-reform certified agreement;
· a preserved State agreement;
· a transitional award;
· a notional agreement preserving State awards;
· an old IR agreement;
· a pre-reform AWA; or
· a common rule award which continues to have effect during the transitional
period.
7.2 Those employers who are not covered by one of these industrial instruments
(such as those on common law contracts) will still need to meet the minimum
meal break requirements.

I think theres a health issue in expecting anyone to work 8 hours every day with nothing to eat, or a decent rest break. They really should have extra staff to cover for ppl when taking breaks.
