The windows 10 download and upgrade is handled by a separate program, which then prompts windows update to upgrade the OS. To further confuse things this program came through by a windows update. i.e. If the program is installed that "offers" you windows 10 then disabling windows update will not stop the download of Windows 10.

If you have a critical PC with Windows 7, 8 or 8.1 installed then you should uninstall update KB3035583

That's also the way to get rid of the pesky icon and upgrade reminder.
