Installing OSX in non-Apple hardware certainly is illegal if you bothered to read the EULA and the relevant legislation here. No ifs, no buts.
At the moment it is not in their interests to enforce this but they could make like tough for the hackintosh crowd if they wanted to - by way of example the AppleTV3, for which there is still no way to jailbreak. They know how to slam the door shut, if they wanted to.
