This is something we should all be aware of when we try to return faulty goods, or if the sellers warranty on defective products has expired.

Thanks ken, I know what you mean with this article, however the writer of those few paragraphs should never have mention that ACCC would get you if one did the wrong thing.

They, the ACCC are a nonsense organization that does nothing.

It is important for everyone to know what their rights are as a consumer.

So far I have

Had a mobile phone replaced after 2 years.
Had Hi-Fi system replaced after 18months
Refunded business shirts because the buttons were too tight around the cuffs and neck.
Sanded the side of my house for free, after burning out 3 orbital sanders in 5 days.
Had a high pressure water cleaner refunded after 12 months.

The worst ones I come across are retailers/manufacturers that insist you pay the cost to ship faulty goods to them to repair. Also US manufacturers (distributing through Australian retailers) that say the warranty starts when the product leaves their warehouse in the US, not when it is sold to the end customer Aust.

Ever bought a brand-new DVD, taken it home and found that it simply refuses to play uninterrupted through to the end ? (Compatibility issues .. there's lots of them, folks).

I have.

I took it back to the shop (Big W). Had a massive argument, as it seemed to work Ok in their DVD players. There were no probs with any other DVDs in any of my players ... except for this particular, newly purchased DVD.

I eventually did get a refund by taking the line that it was simply not "fit for purpose" (aka: viewing), and I didn't care what their policy was, or what their sign said. 'Twas not a particularly pleasant experience.

I notice (now) that most of the big stores display a sign that says:
"DVD purchases will not be refunded (or swapped)".
Just how enforceable is this policy ?

I wonder just who is responsible for integration/compatibility issues ..??…

I recently bought a film strip/photo scanner from Target. It worked the first time I ran it (or so I thought). When I re installed it about 3 weeks later it could not find the scanner (I had a number of tries on different computers without succes) so I took it back for an exchange (I had lost the invoice) they did not have one so I was given a credit.

When I redeemed the credit for a new scanner I took it home and guess what. It had the same problem. I thought there must have been a problem with the driver so I looked at the disc, found the drivers and installed them manually. Works perfectly now. However I then seem to recollect that that is how I installed the driver the first time. Embarrassing isn't it.

Well, at least one can put up an good argument at the time of returning the goods to the shop knowing you are right by showing a copy of the article.
The last resort will be writing to NSW Fair Trading .

And dont be scared of using Fair Trading, they are there to help and are pretty prompt.

They helped me with my phone replacement 8 yrs ago and I am working with them now over a dispute with my builder over a fence they knocked during my house demolition. Took about 5-10min on their website to post the complaint/request, they called me back in 5 days to discuss, I now have an onsite meeting with them and the builder on the 22nd.
