Does anyone know what the requirements under a warranty are.
If something stops working within a short period of time for no apparent reason is the seller obligated to replace that item or can he insist on sending it away for repair.
I've taken things back to K-mart and the like when things haven't worked and they've replaced them but generally thats within a couple of weeks of purchasing.
I can't seem to find any clear law etc on the web concerning this
Thanks

from what i've read they are no obligation to replace, they can get it repaired - which may not be satisfactory, but i think it protects car dealers who sell dodgy cars, they only have to repeir them, not replace

Totally depends on the type of item.
There are relevant regulations covering this. Takes quite a bit of research to get the specifics of a particular item.
Generally, If an item is an electrical device for example, there are different "warranty" requirements than say a skate board.
You also must give the supplier / seller the oportunity to solve the issue. You can not just get something fixed & request the supplier pay the bill, without letting them try to fix it first.

How long did you have it before it broke?

Not even a month and used infrequently in that time
What did you break?
If it is still under warranty you call the make/model of the item and they will tell you where or who to go to in your area to fix it that covers warranty jobs, then they will decide if it is fixable or needs replacing

Trevor, If something I sell screws up within a month, I'll replace it, but that comes out of my pocket. The warranty is provided by the manufacturer, not me. The month figure is just me, if it's going to fail it will do it within a month.
If it's under a month old, I can replace it out of my pocket and use the one that comes back from repair as a new unit elsewhere. I've lost a months worth of manufactures warranty which is ok.
If it fails after a month or more, I'll send it back to the manufacturer for repair. That may take weeks turnaround but I'm not going to bankroll some chinese company for their hardware failures. Let them fix it, but the customer must suffer is the result. I can't provide unlimited warranty on every piece of crap I sell, It's just not realistist.
