Well, sounds like you have already contacted the seller so the best thing to do is give them a chance to respond. Is that an Evostar scope? Looks like an O ring under the locking ring which is what my 72mm had, and a dob of adhesive to keep the locking ring form loosening. That one does not looks like it has crept out onto the glass to me, looks more like a spatter from a bit of air in the tube when they applied the adhesive.
It has been mentioned above, I don't know which way the retailers can go to get a win. Some people get pretty upset if the boxes have been opened and accuse sellers of foisting secondhand or returns as new goods, when what it really is, is a new item that has been inspected by the retailer.
