Joe - this is a real issue with many of these hosting companies - they register the domain in their name, not yours, and it's near impossible to get the domain back from them, especially if it's a tLD not governed by AUDA.
My advice to people it to *always* register your own domain, never let a hosting company do it for you.
I have seen too many people lose their domains this way and it's shocking.
